Taking advice on legality of cameras
IN RESPONSE to M D Johns' letter, (Your Say, October 10) airing comments on my own letter (Your Say, September 15) highlighting the illegalities of the 30 mile per hour speed limit signage approaching Gdynia Way from the direction of Laira via the Embankment.
There was no mention anywhere in my letter that the speed limit signs had to be adjacent to each other and not staggered as suggested in M D Johns' letter, neither is there any such directive laid down in legislation under the traffic signs regulations and general directive act.
My letter categorically stated that at the commencement of any such speed limit, the authorities have a legal obligation to ensure that there are two signs clearly displaying the speed limit, with one sign to be situated on either side of the road and again, neither sign must in any way be obstructed from the approaching view of the motorist, otherwise the speed limit is rendered null and void and indeed illegal, which the photograph printed with my letter undeniably shows this to be the case at this particular site. Whilst I agree that there is a sign on the left hand side of the road, it only becomes visible to the motorist after emerging from under the old railway bridge, but as is adamantly laid down in legislation, should be visible for a far greater distance. Ironically the speed limit sign is completely obscured from view being hidden behind a speed camera warning sign.
It may be of interest to other victims snared at this site, that I am in discussions with the legal profession specialising in traffic signs regulations with a very definite view of bringing action against the illegal issuing of any notice of intended prosecution by the Safety Camera Partnership team.

“Unless you are driving faster than the limit and constantly glaring at your dashboard there is no reason why you cant see all of the traffic signage. A photograph convinietly taken at a position to back up your argument is no defence. Wise up or hang up your keys.”

“If you are going into Gdynia Way, where the cameras are, you would be in the offside lane, and the signs are clearly visible for for several hundred yards from that aspect.
The fact that you chose to take your picture at the nearest possible point where the sign would not be visible from a left hand drive vehicle hugging the kerb is very misleading, and a UK model car in a normal driving position would have far greater visibility of the sign.
However, I do agree that the new diversion signs are distracting and hide the neaside sign from view (rather like overgrown hdges in most of Devon), hence the requirement for an offside one.”
