Will covenant scupper island plans?
WHILE looking into some of Plymouth's history I came across an article on Drake's Island in a site called Victorian Forts which shows the island as empty and unused but also for sale.
Do I assume from this that the applicant for planning approval to develop a luxury hotel on the site is assuming planning permission will be granted and therefore certainly increase it's value from what it was bought for?
However, doing further research I found that when the island was on lease to Plymouth City Council there was a covenant prohibiting any commercial development. One wonders if this covenant is still in place and therefore effect the current planning application.
I think the planning authorities need to investigate this before any decision is made on the planning application and also any potential purchasers needs to check this before proceeding with their purchase.

“Multi millionaire Dan McAulay should give Drakes Island to the National Trust. He only payed £350,000 for it in the 1980's, the man has never done a decent thing in his life, he ruined Argyle and took the airport away. He is a very old man. This could be his last chance to do one good deed before the inevitable happens. Let's hope that his conscience tells him (or his heirs)to give Drakes Island back to the people. He could easily find another island somewhere to build his boutique hotel. The only chance Plymothians will get to visit the island is when they work in the kitchens on minimum wage. Plymouth Council should refuse planning permission, it is a listed building and the National Trust could restore it to its former glory as a fort and open it to visitors. MCAulay is far to selfish to do anything except line his own pockets, luckily, plans are already being made to stop him in his tracks with a National campaign.”

“The hotel is a risky idea anyway, I mean what guest would want the inconvenience of having to hop on a small ferry to get to and from it, especially in windy choppy seas and after dark, dodging warships and other vessels that might be around?”

“The houses in the street where I live are all covered bye a covenant ,it states that they are only for family use , but this covenant is broken bye landlords filling the houses with students .
Plymouth planning dept tells me this is a civil matter and nothing to do with them .
So as far as I can make out covenants are not worth the paper they are written on”
