'Attack left woman blind in one eye'

Tuesday, November 24, 2009, 14:50

A BAR landlady was blinded in one eye after a disgruntled drinker smashed a pint glass into her face, a court heard.

Francine Shailer was rushed to the Royal Eye Infirmary for an operation under general anaesthetic to remove shards of glass from her left eye.

Surgeons found a complex cut, with her eyeball 'punctured like a flat tyre', internal bleeding, a detached retina and damage to the optic nerve.

They rated the damage at 10 out of 10, with Ms Shailer likely to lose the sight of her eye permanently.

Prosecutor Emma Birt told the six-man, six-woman jury that Scott Vanbeck faced two alternative charges: causing grievous bodily harm with intent or causing grievous bodily harm, both of which he denied.

She said the prosecution believed Vanbeck had intended to cause really serious harm.

The court heard that after the incident Vanbeck, from Harwell Court in the city centre, dumped his jacket in a lane to change his appearance, and shaved his head the next day.

But two days later, he told police he wanted to hand himself in after reading in the local press that they were looking for a suspect.

Miss Birt said Ms Shailer, 51 at the time of the incident, owned a shop at Drake Circus called University Wines and the bar underneath, The Pit, which was run by her daughter, though she was the licensee.

On Wednesday, October 1, last year, Ms Shailer finished work at 10.30pm and went to The Pit for a drink with a friend.

Vanbeck was complaining loudly about the quality of the beer and the fact that the '£1 a pint all night' beer had run out.

Miss Birt said: "He was being cocky and arrogant and complaining about false advertising."

At 12.15am a barmaid collecting glasses was told by Vanbeck: "Tell that fat bitch I'm going to make her lose her licence tomorrow."

He also referred loudly to Ms Shailer and her friend as 'those slags.'

Mrs Shailer approached the table where Vanbeck and his friends were sitting to collect their glasses, calling out: "Come along, then," because it was time to leave.

Vanbeck came at her with a pint glass, which hit her in the face, smashing on impact and spilling beer down her neck, the court was told.

Ms Shailer screamed that she had been glassed, and police and an ambulance were called.

Interviewed by police in the presence of his solicitor, Vanbeck said Ms Shailer had tried to grab his glass and he let go.

He didn't realise she was the licensee and had thought she might be trying to take his drink and pour it over him.

He was not drunk, having consumed only about six pints.

Vanbeck said he had shaved his head next day, not to change his appearance but because he did it all the time.

The trial, expected to last three days, continues.
